The Police Action


Mr. CHUNG was finally released. According to the court, he was proved no guilty after the photo that he had accused to posted on the web was verified as no obscene article. However, no compensation was given for his 8-week impirsonment. Chung did not say anything after the Police claimed he would face another charge for default.

The Police did not comment on this case but denied for a faulty charge against Mr. CHUNG even the photo was verified as no obscene article. They explained the case was serious in nature and should be put on charge in the 1st instance even those photos had not yet been verified by the concerned Department. On the other hand, the head of Custom and Excise said they would do in the same manner as the Police.

The action taken and the explaination given by the Police and the Custom and Excise are alarming as it totally voilates the equality of human rights in front of the law. People could be detented or put into jail for some times before a charge is or is not being established. It also means that the law will be executed based on the way to persume people are gulity.

Taking an extreme persumption of someone who has uploaded a `Hello Kitty' photo on the web but judged by the Police of obscene in nature, he will be put on charge and may not be bailed out for a certain period. Of course, everybody knows that it is only a joke and supposes not to happen in Hong Kong. If you do not say no to the Police in this case, it will not be a joke anymore.

Therefore, I strongly oppose what the Police had done to detain Mr. CHUNG but on the other hand beg your support not to post the photo anymore.
